Sang tên sổ đỏ là gì?

Sang tên sổ đỏ là cách gọi thông thường của người dân khi thực hiện thủ tục đăng ký biến động khi chuyển nhượng, tặng cho, thừa kế quyền sử dụng đất, quyền sở hữu tài sản gắn liền với đất.

Theo quy định hiện hành, sang tên là thủ tục bắt buộc phải thực hiện để nhà nước quản lý. Trong thời hạn 30 ngày kể từ ngày có biến động (nghĩa là trong 30 ngày kể từ khi công chứng, chứng thực) thì người dân bắt buộc phải thực hiện đăng ký biến động tại cơ quan đăng ký đất đai có thẩm quyền.

Nếu không thực hiện thủ tục đăng ký biến động đất đai, người dân sẽ bị xử phạt vi phạm hành chính.

2 trường hợp khi sang tên được cấp sổ đỏ mới

Theo quy định tại Điều 41 Thông tư 10/2024/TT-BTNMT, một số trường hợp sang tên Sổ đỏ được cấp Sổ đỏ mới, cụ thể:

1. Các trường hợp đăng ký biến động về quyền sử dụng đất, quyền sở hữu tài sản gắn liền với đất mà trên Giấy chứng nhận đã cấp không còn dòng trống để xác nhận thay đổi.

2. Trường hợp đăng ký biến động về quyền sử dụng đất, quyền sở hữu tài sản gắn liền với đất khi chuyển nhượng, tặng cho, thừa kế mà người sử dụng đất, chủ sở hữu tài sản gắn liền với đất có nhu cầu cấp mới Giấy chứng nhận.

Trong hồ sơ đăng ký biến động phải có đơn theo Mẫu số 11/ĐK; trong mẫu đơn này khi điền thông tin sẽ ghi nhu cầu cấp Giấy chứng nhận mới và không có nhu cầu cấp Giấy chứng nhận mới. Nếu người nhận chuyển nhượng, nhận tặng cho, người thừa kế muốn được cấp Giấy chứng nhận mới thì ghi rõ nhu cầu.
